D. Scott Gurney

After a long career as a construction attorney and Member of Frost Brown Todd LLC, I started Gurney Dispute Resolution LLC to focus on my core strength – resolving construction disputes quickly and fairly without litigation. I believe resolving disputes through mediation and other collaborative processes is better than litigation. 

As a mediator and arbitrator, I use my broad construction law experience to help attorneys and their clients resolve disputes quickly and fairly, whether during the project, at project close-out or in litigation.


Training and Experience

I have received mediator training, including training in "Mediating Complex Construction Disputes," from the Straus Institute for Dispute Resolution at Pepperdine University, the #1 dispute resolution program as ranked by U.S. News & World Report.

I am a member of the American Bar Association’s (ABA) Dispute Resolution Section and have attended its annual educational conference.

I have been on the National Roster of the American Arbitration Association’s (AAA) Construction Industry arbitrators since 2003 and participate in AAA’s training sessions and annual continuing education courses. 

I have been recognized as a leading construction attorney by national peer reviews The Best Lawyers in America® and Chambers USA Client Guide®, and have an AV® Peer Review Rating by Martindale-Hubbell®. I was selected as a 2018 "Lawyer of the Year" in Construction Litigation (Ohio) by The Best Lawyers in America®. Chambers reports that I "bring a practical and knowledgeable approach to resolving claims."

I was selected as a Charter Fellow of the Construction Lawyers Society of America, "an invitation-only international honorary association of preeminent lawyers specializing in construction law and related fields.”

I am a frequent presenter at leading construction and construction law association conferences including Construction Lawyers Society of America (CLSA), Construction SuperConference, Construction Users Roundtable (CURT), IRMI Construction Risk Conference, Associated General Contractors of America (AGC) Conference on Surety Bonding and Construction Risk Management, and Construction Financial Management Association (CFMA) conference.

My article “When (and How) a Mediator Should Evaluate the Case” was published by the ABA Forum on Construction Law, Cincinnati Bar Association, Louisville Bar Association, Ohio Contractors Association, Associated General Contractors of Ohio, and Allied Construction Industries.
